Your rights

Meeting with your manager?

Under the Supreme Courtโ€™s 1975 Weingarten decision, if you reasonably believe discipline could result from an investigatory interview, you have the right to request union representation. Management is not required to inform you of your Weingarten rights; it is your responsibility to know and request.

When you request a rep, management can:

  1. Stop questioning until the representative arrives.
  2. Call off the interview.
  3. Tell you it will call off the interview unless you voluntarily give up your right to a representative โ€” an option you should always refuse.
